learned counsel for the State.
2. The present application has been filed seeking cancellation of the anticipatory bail granted to Opposite Parties vide order dated 11.12.2024 passed in A.B.P. No. 2698 of 2024 arising out of Mahua P.S. Case No. 113 of 2024, registered under Sections 420, 354(B), 120(B), 506, 379 and 34 of the I.P.C.
3. Learned counsel for the petitioner submits that the learned court below has failed to consider the facts of the case
Patna High Court CR. MISC. No.15681 of 2025(2) dt.23-07-2026 2/2 and has granted anticipatory bail to the opposite parties.
4. Accordingly, the present application stands
disposed of with liberty to the petitioner to approach the learned Magistrate concerned, who had granted anticipatory bail to the opposite parties, by filing an appropriate application on the aforesaid ground.
5. If such an application is filed, the same shall be considered and decided by the learned Magistrate concerned, in accordance with law, within a period of one month from the date of its filing, after affording an opportunity of hearing to all concerned parties. In the event of non-cooperation by any party, the learned Magistrate shall be at liberty to proceed ex parte in accordance with law.
