JUSTICE SHAILENDRA SINGH ORAL ORDER 2 10-09-2025 Heard Mr. Pankaj Kumar, learned counsel for the petitioner and Mr. Ashok Kumar Singh, learned APP for the State. 2. Petitioner seeks regular bail in connection with Giriyak (Katrisarai) P.S. Case No. 242 of 2025 dated 09.06.2025 registered for the offences punishable under sections 318(4), 319(2), 336(3), 338, 339, 340(2), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita and sections 66(C) and 66(D) of the Information Technology Act. 3. The main submissions advanced by petitioner’s counsel are that the instant matter relates to the recovery of several debit cards, passbooks, mobiles, laptop and cash from the house of co-accused Gautam Kumar and the petitioner is simply said to be present in the house of the said co-accused when the police party raided and except his presence, there is no allegation against him. Though he is alleged to be involved in the alleged cheating by using technical means but during the course of investigation, no one came before the police alleging to be Patna High Court CR. MISC. No.64155 of 2025(2) dt.10-09-2025 2/2 deceived by this petitioner and mainly on the basis of the alleged recovered articles, the petitioner has been chargesheeted. It is further submitted that the petitioner bears no criminal antecedent and against him, the investigation has been completed. 4. Though learned APP for the State has opposed the bail prayer of the petitioner but has not been able to refute the petitioner’s aforesaid plea as to no one had come forward with the allegation of cheating being committed by this petitioner against him. 5. Heard both the sides and perused the FIR and the trial court’s order. Though the instant matter relates to cyber crime, however, considering the petitioner’s fair and clean antecedent and completion of investigation against him and also petitioner’s aforesaid pleas coupled with his young age, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Giriyak (Katrisarai) P.S.
