ORDER 14.07.2025 On the last date of hearing, none had appeared on behalf of the petitioner. Today also when the matter was called out for hearing, no one has caused appearance for the petitioner. It seems that the petitioner has lost interest to prosecute the case. Even otherwise, the conduct of the petitioner during the pendency of the petition has not remained satisfactory as he has not even taken trouble to appear before the Court on any date of hearing. Thus it not a case where benefit of Probation of Offenders Act, deserves to be extended to the petitioner Accordingly, the instant petition is dismissed with a direction to the learned trial court to secure the presence of the petitioner through coercive measures and to send him to jail for serving his sentence in terms of judgement of conviction and order of sentence passed by the said court as upheld by this Court vide Judgement dated 9th of May 2023 passed in Criminal Appeal earing CRA No. 15/2016.
