1. Heard Mr. N. Ahmed, learned counsel for the petitioner. Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State of Assam.
2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, challenging the order dated 29.01.2025 passed by the
Page No.# 2/2 learned Judicial Magistrate First Class, Kamrup (Metro), Guwahati in Basistha P.S. Case No.920/2024.
3. Today, the learned Additional Public Prosecutor submits that on 24.04.2025 the learned Additional Sessions Judge, FTC No.3, Kamrup (Metro) has already given the vehicle in custody of the petitioner. The photocopy of the said order has been filed by Mr. Sharma.
4. According to Mr. Sharma, the said order has already been complied with.
5. The Investigating Officer of Jorabat out post under Basistha P.S. has already sent a report to that effect stating that the vehicle has already been given in custody of its owner as per the said order.
6. This documents shall form a part of the record.
7. Since the vehicle has already been given in custody of its owner, the present Criminal Petition has become infructuous and stands disposed of accordingly. JUDGE Comparing Assistant
