CONCILIATION ORDER
A joint memo has been filed today which is signed by the parties who are identified by their respective advocates. The joint memo is in respect of the connected petitions bearing Crl.R.P.No.669/2018 and Crl.R.P.No.652/2018. It is stated that the petitioner and the respondent have amicably settled a claim of Rs.6,50,000/- as full and final settlement. A sum of Rs.50,000/- was deposited by the petitioner as per directions of the Appellate Court in Crl.A.No.175/2017 and further a sum of Rs.3,00,000/- was deposited by the petitioner as per directions of the Hon’ble Court.
The petitioner has no objection to release the said deposited amount to the respondent. 2. The petitioner has paid a sum of Rs.3,00,000/- on 13.12.2025 that is today by way of cash as full and final settlement of the amount. Totaling Rs.6,50,000/- as full and final settlement. 3. Clause (d) of the joint memo reads as follows:
“d) The petitioner claims that the 4(four) undated cheques deposited at the time of the availing loan but the respondnet reply that there is two cheques, out of two cheques one cheque used is subject matter of Crl.Rev.Pet and another cheque bearing No.806748 drawn on Canara Bank Hassan, handed over today to the petitioner and further the respondent declares that no other cheques detained by him, and no further
5 claim from the petitioner. The respondent further declares that no cheques has been retained by him. The respondent under takes that not claims any amount from the petitioner in future by using any document or cheques through any person.”
4. In view of the aforesaid full and final settlement, the offence against the petitioner is compounded. The deposited amount before the trial Court shall be permitted to be withdrawn by the respondent/complainant as per rules. The aforesaid cheque No.806948 is returned to the petitioner/accused by the respondent/complainant. 5. In view of the aforesaid, the petitions stand disposed of. Sd/- JUDGE
