1. This is an ofÏce reference.
2. This Court, vide order dated 12.07.2024, passed in MCRC No. 4767 of 2024, while rejecting the bail to the applicant, namely, Mukesh Yadav, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of this order, if there was no legal impediment.
3. The learned Special Judge (NDPS Act), Ambikapur District-Surguja KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 (C.G.) vide his request letter dated 23.01.2025 has requested for grant of some more time for concluding the trial.
4. It transpires from perusal of the PUD, that in this case, statements of 9 prosecution witnesses have been recorded. Only two witnesses, Investigating OfÏcer L.R. Chauhan and Constable Devendra Singh, remain to be examined. To ensure their presence, a non-bailable warrant has been issued against Chauhan and a bailable warrant issued against Singh. The concerned police station in-charge and Superintendent of Police, Ambikapur, have been notified to ensure compliance. Hence the conclusion of the trial is likely to take some time. Therefore, he prays for grant of further more time for concluding the same.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
