Learned counsel for the petitioner has filed a memo which reads as under: The Petitioner above named respectfully submits as follows:

HC-KAR NC: 2025:KHC:49342 CRP No. 83 of 2020 The above CRP arises out of the Order dated 4-1- 2020 passed by the LXXII Addl. City Civil and Sessions Judge, Mayo Hall, Bengaluru, on I.A. No. 2 of 2020 in O.S. 25374 of 2013. The said suit in O.S. 25374 of 2013 was filed by the Respondent firm, represented by its alleged partner by name Sri. N. Vishwanath seeking ejectment of the Petitioner herein relating to the suit schedule property. One Mr. N. Venkatesh (brother of N. Vishwanath) has in his capacity as partner of the very same firm viz., M/s. Narayanaswamy & Sons filed the suit for permanent injunction restraining the Petitioner from continuing to occupy the very suit schedule property, in O.S. No. 2840 of 2014, before the City Civil Judge, Bengaluru. The subject matter of this suit went upto the Apex Court and the Apex Court by Order dated 11-9-2020 directed the Petitioner herein to vacate the suit schedule property on or before 31-3-2021. This is as per Order dated 11-9- 2020 passed in SLP Nos. 3210-3211 of 2020. In obedience/Compliance of the said order of the Apex Court, Petitioner herein has delivered possession of the very same suit schedule property to the very Respondent firm represented by its Partner Mr. N. Venkatesh on 31-3-2021. The Petitioner also cleared all the arrears of rent.

HC-KAR NC: 2025:KHC:49342 CRP No. 83 of 2020 In the light of the Petitioner having vacated the suit schedule property pursuant to the order of the Apex Court, supra, the present CRP does not survive and the same be dismissed as having become infructuous".
