2. The petitioner apprehends his arrest in connection with Motihari Muffasil P.S. Case No. 17 of 2025 dated 07.01.2025 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act and Section 317(5) of BNS.

As per the first information report, on a secret information that a person was preparing and selling liquor, a police team went at the place, one person, who was carrying three plastic gallons on a motorcycle, leaving behind the motorcycle and the gallons, fled away. On search, 80 liters of country made chullai liquor was recovered and the motorcycle and the liquor were seized.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.66020 of 2025(2) dt.24-09-2025 2/2 neither the seized article nor the motorcycle, from which country made liquor is said to have been seized, belongs to the petitioner, who has no criminal antecedents. The petitioner has falsely been implicated in this case.
5. In view of the fact that the petitioner has no criminal antecedents and the seized articles including the motorcycle does not belong to him, this Court is inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No.I, East Champaran, Motihari, in connection with Motihari Muffasil P.S. Case No. 17 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
