Heard Mr. Santosh Kumar Soni, learned counsel for the appellant and Ms. Nehala Sharmin, learned Spl.P.P on behalf of the State.
This appeal is directed against the order dated 05.02.2025 passed by learned Sessions Judge, Hazaribag in B.P. No.67/2025, arising out of Giddi P.S. Case No.79/2023, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on 02.06.2023, some unknown miscreants had come to Religara Project on a motorcycle and had thrown a bomb on the weigh bridge and thereafter, they fled away.
It has been submitted by the learned counsel for the appellant that so far as the appellant is concerned, he has been implicated only on the basis of the mobile phone which was recovered from the possession of the appellant and which was used in demanding levy.
Learned counsel for the appellant has further submitted that the appellant is in custody since 25.07.2024.
Learned Special P.P. has opposed the prayer for bail of the appellant. Regard being had to the period of custody undergone by the appellant, we, while setting aside the order dated 05.02.2025 passed by learned Sessions Judge, Hazaribag in B.P. No.67/2025, arising out of Giddi P.S. Case No.79/2023, direct that the appellant, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Priyanka Chopra, learned J.M.F.C., Hazaribag, in connection with Giddi P.S. Case No.79/2023. This appeal is allowed.
