The applicant who is in custody since 07.01.2023 has renewed the prayer for grant of regular bail in connection with Gawan P.S. Case No.02 of 2023 (POCSO Case No.38 of 2023) registered for the offence under Sections 376/506 IPC and Section 3/4 of the POCSO Act, pending in the court of learned Special Judge, POCSO Act, Giridih. 2. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 3. Earlier the bail application of this applicant was rejected vide orders dated 12.06.2023 and 26.07.2024 passed in B.A. No.3372 of 2023 and B.A. No.2635 of 2024. This is the third attempt. Referring to the cross examination of the victim girl prayer for bail of the applicant has been renewed stating that the F.I.R. has been lodged by somebody else and it may be a case of false allegation. On the above basis, prayer for bail has been renewed. 4. Learned A.P.P. has opposed the prayer for bail of the applicant. 5. Considering the statement of the victim girl, I am not inclined to reconsider the prayer for bail of the applicant, at this stage.
