Neutral Citation No. - 2025:AHC:111388 Court No. - 34 Case :- WRIT - C No. - 21841 of 2025 Petitioner :- Om Prakash Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Gyanedra Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Rohit Ranjan Agarwal,J. 1. This writ petition has been filed with the following prayer:- "i. Issue a writ order or direction in the nature of mandamus commanding and directing the respondent no.2 to execute the order dated 27.12.2024 passed by respondent no.2 in case No.RST/1284/2022, (Computerized Case No. T202214180101284) Om Prakash and others Dhanya Prakash under section 116, U.P. Revenue Code, 2006 within short stipulated period as fixed by this Hon'ble Cotur in the interest of justice." 2. It is contended by learned counsel for the petitioner that partition decree was passed on 27.12.2024 against which no appeal was filed, the said fact has been stated in para no. 9 of the writ petition. The sole prayer made is for getting the said partition decree executed. The petitioner has already moved an application before revenue authorities, which is pending consideration. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent no. 2 to execute the order dated 27.12.2024 passed in Case No. RST/1284/2022, Computerized Case No. T202214180101284 (Om Prakash and others vs. Dhanya Prakash), if there are no legal impediments, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
