Neutral Citation No. - 2025:AHC:118034 Court No. - 77 Case :- APPLICATION U/S 528 BNSS No. - 24227 of 2025 Applicant :- Ahsanuddin Opposite Party :- State Of U.P. Through Its Principal Secretary Home U.P. Lucknow & Another Counsel for Applicant :- Mohammad Sadab Khan Counsel for Opposite Party :- G.A. Hon'ble Saurabh Srivastava,J.
1. Heard learned counsel for the parties.
2. Present application has been preferred with prayer to quash the impugned charge-sheet dated 12.05.2025 in Case Crime no. 68 of 2025 under sections 3, 5, 8 of Prevention of Cow Slaughter Act & 11(1)(f)(1) of Prevention of Cruelty to Animal Act against the applicant, PS- Kotwali Kalpi, District Jalaun as well as impugned cognizance order dated 22.05.2025 passed by learned Chief Judicial Magistrate, Jalaun at Orai in Case no. 6957 of 2025 (State vs. Sikandar & others).
3. At the very outset, learned counsel for applicant submitted that in the present case charge-sheet has been submitted against applicant and other co-accused persons only on the basis of confessional statement which is complete violation of Circular No. 30/2024 dated 03.07.2024 issued by Director General of Police, Uttar Pradesh and as such is liable to be quashed.
4. Per contra, learned AGA vehemently opposed the prayer sought through instant application.
5. After hearing the rival submissions extended by learned counsels for the parties and perusing the record including the charge-sheet appended at page no. 71, it appears that charge-sheet in the present case has been filed by concerned Investigating Officer on the basis of investigation, statement of informant, statement of witnesses, spot inspection, statement of veterinary doctor, analysis report of concerned hospital and other evidences appended with the charge-sheet. Hence, the ground raised by
learned counsel for applicant that charge-sheet has been submitted only on the basis of confessional statement is entirely frivolous and misconceived. No other ground has been raised by learned
counsel for applicant while arguing the instant matter.
6. In view of foregoing discussion, present application u/s 528 BNSS being devoid of merit stands dismissed.
