The instant petition has been filed for following relief: "i. Issue direction to the Court of Fast Track Court (J.D.) Court No.1, Varanasi to decide the Execution Case No. 3/2015 (Kusum Pandey Versus Ram Bachan) pending in the Court of Fast Track Court (J.D.) Court No.1, Varanasi expeditiously within the period stipulated by this Hon'ble Court." 2. From perusal of the writ petition, it appears that aforementioned execution case is pending since 2015 and the same has not been decided despite several dates have been fixed. 3. No useful purpose would be served in keeping this petition pending. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to Court of Fast Track Court (J.D.) Court No.1, Varanasi to consider and decide the Execution Case no. 3 of 2015, if not already decided, in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
