The petitioner is before this Court seeking a direction to the respondent bank to return the gold jewels pledged as security for repayment of the loan borrowed by the husband of the first petitioner. 3. The first petitioner is the wife, the second petitioner is the mother and petitioners 3 and 4 are the children of Anand @ Anandhan, who had borrowed the loan from the respondent bank. The petitioners state that he is missing, a missing complaint has been lodged and his whereabouts are not known as on date. Therefore, the first petitioner has cleared the entire loan amount borrowed by the said missing person and made a request to the respondent bank to return the gold jewels pledged by him. 2/5 https://www.mhc.tn.gov.in/judis WP(MD). The learned counsel for the respondent bank submitted that the claim of the petitioners would be considered subject to payment of the entire loan amount, including interest and also subject to the petitioner satisfying the other requirements and formalities as required by the respondent bank. 5. Accordingly, this writ petition is disposed of with a direction to the respondent to return the gold jewels pledged by Anand @ Ananthan, subject to the petitioners clearing the entire loan amount due as on date, if not already repaid and subject to the petitioners executing an indemnity bond indemnifying the bank against any future claims by third parties. 6. The aforesaid exercise shall be completed within a period of two (2) weeks from the date of receipt of a copy of this order. 7.
