This application under Section 528 BNSS has been preferred for quashing of the N.B.W. order dated 17.11.2021, passed in Session Trial No. 338 of 2019 (State v. Ajay and others), arising out of Case Crime No. 790 of 2018, under Sections 395, 412 of IPC, P.S.- Sector- 20, Noida, District- Gautam Buddha Nagar, pending in the court of Additional Sessions Judge-6, District- Gautam Buddha Nagar. 3. It is submitted by learned counsel for the applicant that in the aforesaid case the applicant was on bail but in the year 2021, he has gone to other State for labour work, due to which, he could not appear before the trial court and non-bailable warrants were issued against him. It was next submitted that the applicant would appear before the trial court concerned and a direction may be made to the trial court to decide the bail application of applicant expeditiously and till then, protection may be granted to him. 4. In view of aforesaid, it is directed that in case, applicant appears/ surrenders before the court concerned within a period of two weeks from today and applies for bail, his bail application shall be considered and decided expeditiously, in accordance with settled law. 5.
