ORAL ORDER
1. The present successive bail application has been preferred by the applicant – original accused No. 2 under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (for short, “BNSS”) in connection with FIR No. 11195050220859 of 2022 registered at Tharad Police Station, Vav-Tharad.
2. Learned advocate Mr. Nirav K. Padhiyar for the applicant submitted that the present applicant–accused no. 2 is in jail for the oCences punishable under Sections 65(a), 65(e), 116-B, 98(2), 99 and 81 of the Gujarat Prohibition Act. It is further submitted that the present applicant – accused was arrested on 29/09/2025 and is presently in jail.
3. On perusing the case on hand, it appears that during patrolling at Khoda Check Post on 17/11/2022, the police intercepted a tanker bearing registration No. GJ-12-BV-9781, from
R/CR.MA/24622/2025 ORDER DATED: 05/12/2025 which liquor worth Rs. 8,28,840/- was allegedly recovered and Accused No. 1 was arrested from the spot. During the interrogation, Accused No. 1 is stated to have disclosed that the present applicant – Accused no. 2 had loaded the liquor into the said tanker, on the basis of which the investigating agency implicated the applicant in Prohibition C.R. No. 11195050220859 of 2022 registered at Tharad Police Station, resulting in his arrest on 29/09/2025.
4. It further transpires that the co-accused-Accused no. 1 has been released on regular bail by the coordinate bench of this Court vide Criminal Misc. Application No. 903 of 2023. It also transpires that the investigation is over and the charge-sheet has been Fled. It is further submitted by the learned advocate for the applicant that the present applicant has no past antecedents.
5. Learned APP for the State has submitted that considering the
facts and circumstances of the case, appropriate order may be passed.
6. In view of the above, RULE. Learned APP waives service of Rule for the respondent – State. The applicant – accused is ordered to be released on bail, if he is not required in any other oCence, on the following terms and conditions:- (i) The applicant – accused shall furnish personal bond in the sum of Rs.10,000/- with the surety of the like amount before the learned trial Court. (ii) Not to misuse the liberty granted to him by this
R/CR.MA/24622/2025 ORDER DATED: 05/12/2025 Court and shall not involve himself in any other oCence; (iii) The applicant – accused shall furnish the correct and permanent address with the documentary evidence before the learned trial Court and shall also intimate the Court concerned in the event of change of any address. (iv) Not leave India without prior permission of this Court.
7. Direct service is permitted.
