CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY
---------
For the Petitioner : Mr. Anup Kr. Agarwal, Advocate
For the State : Mr. Abhay Kr. Tiwari, A.P.P.
---------
07/28.07.2025 Heard Mr. Anup Kr. Agarwal, learned counsel for the petitioner and Mr. Abhay Kr. Tiwari, learned A.P.P. for the State.
The prayer for bail of the petitioner was earlier rejected twice in B.A. No. 10013 of 2019 and B.A. No. 6382 of 2024.
It has been by the learned counsel for the petitioner that there has been no progress in the trial. It has further been submitted that the seizure list does not indicate that the mobile of the deceased was recovered from the possession of the petitioner. Learned counsel submits that the petitioner is in custody since 27.10.2018.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
The status report which was called for reveals that out of 08 charge-sheet witnesses 04 witnesses have been examined which would mean that there is no possibility of the trial being concluded in the near future.
On consideration of the period of custody undergone by the petitioner and the delay in conclusion of the trial, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Addl. Sessions
