Learned counsel representing the respondent submits that he has no objection in case the present application is allowed. In view of the averments made in the application, the same is allowed and the delay in filing the appeal is ordered to be condoned. Application stands disposed of.
Cr. MP No._____ of 2025 (Cr.-MPMST No.1137 of 2025). Heard. It appears from the judgments of learned Courts below that while the learned Trial Court found the testimony of the injured to be credible, the learned Appellate Court acquitted the accused on the ground that one of the witnesses had enmity with the accused and the two witnesses were given up; hence, an adverse inference was to be drawn against the prosecution. The testimony of the informant was also rejected in view of the fact that there was no corroboration from the
independent witnesses, prima-facie, once the testimony of the informant was found to be credible by the learned Trial Court such finding regarding the credibility could not have been reversed by the learned Appellate Court as the learned Trial Court had benefit of watching the demeanous of the witntess while assessing his credibility. Therefore there are arguable points involved in the present appeal and the leave petition is granted. Application stands disposed of. Cr. Appeal No. _____ of 2025 (Cr.-AST No.930 of 2025).
Since the delay in filing the appeal has been condoned vide separate order passed in Cr. MP(M) No.530 of 2025, the Appeal be registered. Copy of the appeal has been supplied to
