Mr. Sagar Kothari, Advocate for the petitioners. 2. Petitioners filed a suit for injunction along with a temporary application. Learned Trial Court has issued notice on petitioners’ temporary injunction application, fixing 03.07.2025. 3. Learned counsel for the petitioners contends that in view of the facts and circumstances of the case, they were entitled for ex parte ad interim injunction. 4. This Court is not impressed by the said submission. In view of provisions contained in Order 39 Rule 3 CPC, the course of action adopted by learned Trial Court is just and proper. Thus, there is no scope for interference. The Writ Petition, however, is disposed of with request to Trial Court to make endeavour to decide the application filed by petitioners in the suit on the next date fixed, if all the defendants are served. 5. If for any reason, it is not possible to do so on the said date, then the same shall be considered and decided on any other date within two weeks thereafter.
