Mishra, learned counsel for applicant and learned AGA for State. 2. Applicant is facing trial for offence of kidnapping and murder of a boy aged about 5 years. 3. Learned counsel for applicant submits that applicant is in jail since 13.02.2022 i.e. more than 3 years and till date out of proposed 12 witnesses, only 1 witness has been examined and its cross-examination was concluded in more than 1 year. 4. I have considered status report dated 01.08.2025 which shows that now statement of PW-1 is over and examination-in-chief of PW-2 is also over and her cross- examination is fixed for 06.08.2025. 5. Learned AGA has opposed the bail. 6. I have considered above submissions and taking note of nature of allegations against applicant, despite period of incarceration, this Court does not find any ground to consider present bail application. 7. Accordingly, bail application is rejected. 8. However, in case trial is not substantially progressed or concluded within 8 months from today, the applicant will be at liberty to approach this Court or trial Court along with status report.
