Neutral Citation No. - 2025:AHC:111711 Court No. - 4 Case :- WRIT - A No. - 9291 of 2025 Petitioner :- Juhi Gaurh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Atmaram Nadiwal,Dinesh Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Gaurav Kumar, learned Advocate holding brief of Sri Dinesh Kumar Yadav, learned counsel for the petitioner, Sri Sunil Kumar, learned counsel for respondent no. 4 as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has assailed the notice dated 01.07.2025, whereby, he has been directed to furnish explanation as to why her appointment as Anganbadi Worker may not be set aside for her income certificate being cancelled by the competent authority. Learned Standing Counsel has raised a preliminary objection as to the maintainability of this petition at this stage on the ground that petitioner has since only issued with the notice to furnish reply whereof and the authority may be directed to take decision in the matter. Learned Standing Counsel further submits that since income certificate of the petitioner has been cancelled it will be more appropriate for the petitioner to challenge the income certificate before the appropriate forum. Sri Sunil Kumar Singh, learned counsel for respondent no. 4 has adopted the argument advanced by learned Standing Counsel. In view of the above, I decline to entertain this petition at this stage. However, I hereby provide that if petitioner prefers reply to the notice dated 01.07.2025 within a period of four weeks from today, the competent authority in the matter namely the District Programme Officer, Azamgarh shall be deciding the matter by means of reasoned and speaking order within a further period of six weeks. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 11.7.2025 IrfanUddin Digitally signed by :- IRFAN UDDIN SIDDIKI High Court of Judicature at Allahabad
