The prayer in this petition is for quashing of an FIR No.159 dated 31.05.2021 registered under Sections 323, 324, 326 IPC (Section 326 IPC added later on) at Police Station Sadar Nabha, Tehsil Nabha, Distt. Patiala along with all consequential proceedings arising therefrom on the basis of a compromise arrived at between the parties.
2. The learned counsel for the petitioners contends that petitioner No.3 has passed away. He contends that a compromise was arrived at between the parties in furtherance of which their statements were recorded and a report has also been submitted before this Court by the JMIC, Nabha to the effect that the compromise was genuine, voluntary and out of the free will of the parties. CRM-M-45761-2021 -2- same, the FIR and the consequential proceedings ought to be quashed in view of the settlement arrived at between the parties.
3. On the other hand, the learned State counsel along with the
learned counsel for respondent No.2 contend that though a compromise had been arrived at and the statements in support of the compromise were duly recorded by JMIC, Nabha who submitted a report regarding the genuineness of the compromise, later, respondent No.2 was assaulted once again on 05.08.2022 and the medico legal examination of respondent No.2 took place leading to MLR No.AK/02/NBH/2022 as per which respondent No.2 has suffered the following injuries:- i) C/o pain left hand, no external injury seen, advice ortho opinion and investigation as needed. ii) A lacerated wound APP 4.5 x 0.5 cm over left parietal region, suturing LA, done, advice X-ray and surgery opinion. Iii) C/o pain right hand, no external injury seen advice X- ray and ortho opinion. They thus, pray that the present petition is liable to be dismissed.
4. I have heard the counsels for the parties.
4. Undoubtedly, initially a compromise had been arrived at between the parties because of which statements in support thereof were made before the JMIC, Nabha. However, after recording of the statement, respondent No.2 has been assaulted once again by the petitioner. Therefore, apparently, the question of the compromise being sustained would not arise.

5. In view of the above, I find no merit in the present petition. Therefore, the same stands dismissed.
6. However, if at a subsequent stage another compromise is arrived at to the satisfaction of both the parties, the petitioners are at liberty to approach this Court once again by way of an appropriate petition.
