2. The memo reads as follows:
“The Petitioners have filed the above writ petition challenging the order passed by the court below rejecting the application filed by them for amendment of the written statement. During the pendency of the writ petition, the Respondent had filed an application before the court below seeking for impleading his son as a Plaintiff and the said application came to be allowed by the court and after the amended plaint was filed, the Petitioners were permitted to file the additional written statement and they have filed the additional written statement before the court below incorporating the amendments which were sought in the application filed before the court below. The said additional written statement has been taken on record by the court below and the proposed amendments are part of the said additonal written statement filed by the Petitioners. In this background, the above writ petition has become infructuous and the same does not survive for
consideration.
In the background of what is stated above, it is prayed that this Hon'ble Court be pleased to dismiss the above writ petition as having become infructuous, in the interest of justice and equity.”
In terms of the memo, the writ petition is disposed as having become infructuous.
