1. Heard learned counsel appearing on behalf of the parties.
2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner is challenging the order dated June 28, 2024 passed by respondent no.2 being the Additional District Magistrate (Finance & Revenue)/Additional Collector, Agra in Case No.1120 of 2024 computerized case no.D202401010001120 (Punjab National Bank Vs. Krishna Gopal and another) under Section 14 of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as 'the Act').
3. It is to be noted that the auction has taken place in the month of December, 2024 and the sale certificate has been issued on January 16, 2025.
4. In light of the same, we do not see any reason to interfere in
order passed under Section 14 of the Act, especially since the petitioner has already filed a Securitisation application before the Debts Recovery Tribunal in which no interim order was passed by the Debts Recovery Tribunal.
5. Accordingly, we are not inclined to intervene in this matter. The writ petition is dismissed.
