None for respondent No.2 SHALINI SINGH NAGPAL (Oral) Petitioner seeks quashing of FIR No. 243 dated 18.10.2019 under Sections 498-A and 406 Indian Penal Code, Police Station Sirhind, District Fatehgarh Sahib and all consequential proceedings arising therefrom, on the basis of compromise dated 29.12.2023 said to be arrived at between the parties. On 06.08.2024/17.09.2024/20.12.2024, this Court directed the parties to appear before the trial Court/Illaqa Magistrate for recording of their statements with regard to compromise on 21.02.2025 and also
directed petitioner to deposit costs of Rs. 25,000/- with Punjab and Haryana High Court Bar Clerks Association, Chandigarh (Regd. No. 2441/1995) Bank Account No. 65004775776, State Bank of India, IFS Code SBIN0050306, High Court Branch, Chandigarh. Copy of receipt of deposit has been placed on record.

CRM-M-37853-2024 -2- In compliance of the order dated 20.12.2024, parties appeared before learned Additional Chief Judicial Magistrate, Fatehgarh Sahib on
05.03.2025. Statement of the Investigating Officer, Jasvir Singh, No. 243-FGS, CIA Staff Sirhind was also recorded on 05.03.2025. Learned Additional Chief Judicial Magistrate, Fatehgarh Sahib has submitted his report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Point-wise report as under has been submitted:
1. As per statement of IO Jasvir Singh, CIA Staff, there is only one accused namely Lakhwinder Singh son of Jung Singh, resident of village Mangwal, House No. 123, Ahluwaliyan Patti, P.S. Balian, Tehsil and District Sangrur, in this case. There is no other accused in this case.
2. As per statement of IO ASI Jasvir Singh, CIA Staff, there is only one aggrieved person i.e. complainant namely Gagandeep Kaur daughter of Bhupinder Singh, resident of Mohalla Bedian, Railway Road, Hamayunpur, Sirhind, District Fatehgarh Sahib, in this case. There is no other aggrieved person in this case.
3. As per statement of IO ASI Jasvir Singh, CIA Staff, no accused has been declared as a proclaimed person in this case nor any such proceedings have been initiated. Since the matter has been amicably resolved, continuation of the criminal proceedings would be an exercise in futility. The dispute which has its genesis in a matrimonial discord, warrants exercise of powers under Section 482 Cr.P.C. Following principles of law laid down by the Full Bench
Judgment of this Court in “Kulwinder Singh and others Vs. State of Punjab and another” 2007(3) RCR (Criminal) 1052 and Hon’ble Supreme Court in “Gian Singh Versus State of Punjab and others” (2012) 10 SCC 303, the petition is allowed. FIR No. 243 dated 18.10.2019, under Sections 498-A and 406 Indian Penal Code, Police Station Sirhind, District Fatehgarh Sahib, along with all the subsequent proceedings arising therefrom, are quashed qua the petitioner.
