Hon'ble Jayant Banerji,J. Petitioner intended to participate in an auction for which he claims to have deposited certain amount with the Nagar Panchayat, Uruwa Bazar, District Gorakhpur. According to the petitioner the tender has been cancelled and the token amount has not been refunded. A representation has also been made to the fourth respondent, in this regard, which is stated to be pending. Sri N.N. Mishra, appearing for respondent nos.4 and 5 states that an appropriate decision would be taken by the concerned respondents, in accordance with law, on petitioner's claim. In that view of the matter, we dispose of this petition with a direction upon respondent no.4 to accord consideration to petitioner's pending claim for refund of the amount deposited as token money by passing appropriate order, within a period of four weeks, from the date of presentation of certified copy of this order.
