Writ petitioners were appointed Gram Panchayat Vikas Adhikari in Panchayati Raj Vibhag of the State Government. District Panchayati Raj Officer, Udham Singh Nagar allocated the Gram Panchayat Adhikaris to different Gram Panchayat vide order dated 03.01.2018. Writ Petitioners challenged the said allocation order by filing WPSS No. 529 of 2018. The said writ petition was decided in terms of judgment dated 01.05.2017 rendered in WPSS No. 1699 of 2016 and Authorities were restrained from transferring the respondents outside their cadre. Thus, feeling aggrieved by the order passed by learned Single Judge on 01.05.2017, State has preferred this appeal. 4. Since the impugned judgment is based on judgment rendered in WPSS No. 1699 of 2016, which was not challenged by the State, therefore, we are not inclined to interfere with the impugned judgment. 5. The special appeal is, however, disposed of with liberty to the Competent Authority to pass order as per the provisions contained in Chapter VI of Uttarakhand Panchayati Raj Act, 2016 (Ashish Naithani, J.)
