CITY CIVIL AND SESSIONS JUDGE, BENGALURU (CCH-46) HAS IMPOSED THE CONDITION NO.2 i.e., THE ACCUSED/ PETITIONER SHALL SURRENDER HIS ORIGINAL PASSPORT BEFORE TRIAL COURT IMMEDIATELY AFTER ITS RENEWAL AND WHENEVER THE PETITIONER WANTS TO TRAVEL OUT OF COUNTRY THEN HE SHALL APPLY FOR RELEASE OF HIS PASSPORT AFTER PRODUCING THE RELEVANT DOCUMENTS SUCH AS, FLIGHT TICKETS ALONG WITH NECESSARY APPLICATION AND ETC. ORAL ORDER
1. Petitioner is before this court seeking for the following reliefs:
(a) Set-aside the impugned order Annexure A order dated 17.09.2025 in SC No.717/2022, passed by the the Hon'ble 45th Addl. City Civil & Sessions Judge, Bengaluru (CCH-46) has imposed the condition No.2 i.e., the accused/petitioner shall surrender his original passport before trial court immediately after its renewal and whenever the petitioner wants to travel out of country then he shall apply for release of his passport after producing the relevant documents such as, flight tickets along with necessary application;
(b) Modify the condition No. 1 in Annexure. A in order dated: 17.09.2025, in SC No.717/2022 passed by the Hon'ble 45th & Addl.
City Civil & Sessions Judge Bengaluru (CCH-46) short validity passport and direct to 2nd respondent-Regional Passport Officer, Bengaluru, 8th Block, 80 feet Road, Koramangala, Bengaluru, to renew the passport for a period of 5-10 years of the petitioner and to issue the renewed passport to him;
(c) pass the necessary order or appropriate writ in this matter;
(d) Grant such other reliefs as this Hon'ble court deems fit in and proper, advance justice to the petitioner."
2. What is essentially challenged is an order dated 17.09.2025 passed by the XLV Additional City Civil and Sessions Judge, Bengaluru on a application filed by the petitioner. The present writ petition would therefore not

be maintainable. Reserving liberty to the petitioner to challenge the said order before the appropriate forum in appropriate proceedings, the petition stands disposed of. SD/- (SURAJ GOVINDARAJ) JUDGE
