V/s SHAILENDRA KUMAR AND ORS.

CORAM:
HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE
(ORDER) 19.03.2025
In the instant petition, petitioners herein have alleged non- compliance of the order passed by this court dated 23.05.2023 in OWP No. 01/2018. It would be profitable to reproduce paragraph 3 and 4;
“3. Having regard to submissions made by learned counsel for the parties,
this petition is disposed of with a direction that if petitioner makes a representation
within two weeks, the respondents shall consider and decide the same afresh. Let this
exercise be completed within a period of two months from the date certified copy of this
order along with writ petition is served upon respondents.
4. This order has been passed strictly on the basis of submissions made by
learned counsel for the parties and no expression or finding has been returned by this
Court regarding the facts and grounds taken in petition.”
Learned counsel for the respondents have produced copy of the
consideration order dated 16.12.2024, whereby the claim of the petitioner has been examined by the respondents and has been found devoid of any merit. Same is taken on record. Respondents have implemented order passed by this court in its letter and spirit. However, liberty is granted to
the petitioners to challenge the consideration order dated 16.12.2023, if they desire to do so.
