The petitioners have filed an appeal before the Chief Executive Officer, Yamuna Expressway Industrial Development Authority, Noida against the demolition order dated 29.01.2025 passed under Section 10 of the U.P. Industrial Area Development Act, 1976 read with the demolition Rules. 3. The case of the petitioners is that the Appellate Authority has not considered the stay application filed by the petitioners along with memo of appeal and there is threat of the demolition order being implemented. 4. Shri Shadab Husain, learned counsel holding brief of Shri Aditya Bhushan Singhal, learned counsel for the respondent- Authority states that the appeal will be decided expeditiously. 5. Having regard to the submissions made, we dispose of the instant petition by providing that the stay application filed by the petitioners be decided on the next date as far as possible and also to decide the appeal in three months. 6. Until the stay application is decided, the order under challenge in appeal will not be given effect to. The stay application will be decided without being influenced by the protection granted to the petitioners by the instant order.
