3. The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. Taking the allegations to be correct, only a simple injury on the complainant and grievous injury on the person of Balwinder Kaur have been attributed to the petitioner.
As he is a first time offender, in custody since 17.04.2025 but none of the 20 prosecution witnesses has been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail. 4. The learned counsel for the State on the other hand has filed Status report dated 06.09.2025 in the form of an affidavit of Mr. Kulbir Singh Sandhu, PPS, DSP, Nangal, District Rupnagar in the court today, which is taken on record. While referring to the same, he contends that the allegations levelled against the petitioner do not entitle him to the concession as prayed for. He however concedes that the petitioner is a first time offender, in custody since 17.04.2025 and that none of the 20 has been examined so far. 5. I have heard the learned counsel for the parties. 6. The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the trial.
