Mr. Pranav Singh, learned counsel for the applicant.
2. Mr. Deepak Bisht, learned Deputy A.G. along with Mr. Vikash Uniyal, learned Brief Holder for the State.
3. Applicant- Raees, who is in judicial custody in connection with FIR No. 775 of 2024, under Sections 127(2), 310 (2), 317(3) of B.N.S.S., registered at Police Station Kotwali Manglaur, District Haridwar has sought his release on bail.
4. Heard learned counsel for the parties and perused the record.

As per the FIR dated 08.09.2024, the informant alleged that on 07.09.2024 at around 10:45 P.M., a woman knocked on his door and requested Rs. 10,000/- to him and upon his refusal, the woman made a phone call, following which three persons arrived and looted `1,00,000/- and some jewellery from his house.

Learned counsel for the applicant would submit that the applicant is innocent and has falsely been implicated. He is not named in the FIR, and his name surfaced only in the confessional statement of co-accused Mehraj. Furthermore, no identification parade was conducted. The applicant is languishing in jail since 15.09.2024.
7. He would further submit that co-accused Sadiq, who is alleged to have played a similar role, has already been granted bail by this Court vide
order dated 09.05.2025. Therefore, the applicant also deserves to be granted bail on the ground of parity.
8. Per contra, learned State counsel would oppose the bail application. However, upon a query from the Court, it is confirmed that co-accused Sadiq has been granted bail and that the applicant has been in custody since 15.09.2024.

9. Having considered the submissions made by both parties and without expressing any opinion on the merits of the case, this Court is of the view that the applicant is entitled to be released on bail.
10. Accordingly, the 1st bail application is allowed.
11. Let the applicant Raees be released on bail in the aforesaid case on his executing a personal bond and furnishing two reliable sureties each in the like amount, to the satisfaction of the court concerned. [
