Heard Mr. Sanjay Kumar Srivastava, learned counsel for the petitioner, Mr. Bhanu Pratap Singh Kachhawah, learned counsel for respondent nos.2 & 3 as well as learned Standing Counsel for the State-respondents and perused the record. The petitioner has preferred instant writ petition for a direction upon respondent no.3 to decide the claim of regularization of appointment of petitioner in the light of Dying in Harness Service Rules, 1974 as well as in the light of letter dated 19.06.1987 issued by Secretary U.P. Basic Education Board and regularize the service of petitioner from the date of appointment with all consequential benefits by passing appropriate order within stipulated period. Learned counsel for the respondent nos.2 & 3, on the basis of instructions, submits that the representation as placed by the petitioner is under consideration, accordingly, the same shall be decided within stipulated period as directed by this Court. Considering the facts of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the respondent no.3, District Basic Education Officer, Etah to decide the representation as moved by the petitioner in accordance with law, as expeditiously as possible, by passing a reasoned and speaking order, after giving proper opportunity of hearing to the petitioner, preferably within a period of one month from the date of production of certified copy of this order, if there is no other legal impediment.
