S. No. 53 Regular Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR
WP(C) 1169/2021 Arif Ahmad Ganie …Appellant/Petitioner(s) Through: Ms. Nighat Amin, Advocate vice Mr. Bhat Fayaz Ahmad, Advocate Vs. J&K Cable Cart Corporation Limited and Ors. ...Respondent(s) Through: Mr. Furkan Yaqoub, GA CORAM:
HON’BLE MR JUSTICE VINOD CHATTERJI KOUL, JUDGE
O R D E R 28.07.2025 Objections have been filed. The petitioner is working as casual labour in J&K Cable Car Corporation Limited, Gulmarg Gondola. He has been transferred to Jammu Ropeway Project. He assails his transfer from Gulmarg to Jammu on the ground that he, being a casual worker and getting minimum wages, is not to be sent to Jammu as same will adversely affect his livelihood. Similar issue has been considered in WP(C) 924/2022 wherein writ petitioner also challenged his transfer to Jammu Ropeway Project. This Court while considering said writ petition, came to conclusion that writ petitioner was not entitled to such a relief and dismissed it. In view of above and having regard to the judgment dated 09.05.2022 in WP(C) no.924/2022, which has binding precedent insofar as the present case is concerned, the instant writ petition is not maintainable, and is, accordingly dismissed.
