JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 3 08-01-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with regard to petitioner No. 2. 2. Permission is granted. 3. The anticipatory bail application with regard to petitioner No. 2 is, accordingly, dismissed as withdrawn . 4. Heard learned counsel for the petitioner No. 1 and the State. 5. Petitioner No. 1 apprehend arrest in a case registered for the offences punishable under Sections 76, 77, 78(D), 351 (2) of the Bharatiya Nyaya Sanhita and Sections 66 (c) , 67 (e) of the Information Technology Act. As per prosecution case , on 30.04.2024 petitioner No. 1 came to the house of co-acused Basant Chaudhary and both of them conspired to defame daughter of informant by sending obscene photos of daughter of informant at her daughter’s husband phone whereafter she is being harrassed by her in – laws. 7. Learned counsel for the petitioners submits that submits that petitioner No. 1 married to elder duaghter of the informant namely Aarti Devi and there is some dispute between both of them for which petitioner No. 1 along with his family went to the village Kanchanpur PS Rafiganj ( village of the informant) for Panchayati where they were assaulted by the prosent prosecution party for which elder brother of petitioner No. 1 Bharat Chaudhary lodged Rafiganj P S Case No. 128 of 2024 against informant and others and in retaliation this false and concocted case has been lodged against the petitioner. 8. Learned counsel for the informant vehemently opposed the bail application. 9. Considering the aforesaid facts and circumstances this anticipatory bail is allowed and it is ordered that let the above named petitioner No. 1 in the event of their arrest/surrender before the court below within a period of eight Patna High Court CR. MISC. No.70404 of 2024(3) dt.08-01-2025 3/3 weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Cyber P.
