1. Heard learned Counsel for the petitioner and the learned A.G.P, for respondent – State.
2. Our attention is invited to the impugned order dated 2nd February, 2023 passed by respondent No.5 - The Education Oicer (Secondary), Zilla Parishad, Kolhapur rejecting the proposal for individual approval to the appointment of the petitioner in the post of “Peon”. 3. Learned A.G.P though argued in support of the impugned
order, we are inclined to set aside the impugned order on the ground that adequate opportunity was not granted to the petitioner and Management to explain/cure deiciencies. Respondent No.5 – The Education Oicer (Secondary) to decide the proposal dated 1st November, 2022 submitted by the Management afresh, in accordance with law, within twelve weeks from the date of communication of this
order. The Management to cure/explain the deiciencies within a period of four weeks from today. If approval is granted, Shalarth ID be issued expeditiously.
4. The petition is disposed of in the aforesaid terms. No order as to costs.
