Neutral Citation No. - 2025:AHC:112655-DB Court No. - 29 Case :- WRIT - C No. - 22111 of 2025 Petitioner :- Yadvendra Singh Yadav Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Satyawan Yadav,Surya Ditya Yadav Counsel for Respondent :- C.S.C.,Tejasvi Misra Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J. 1. Heard learned counsel for the petitioner, Shri Dilip Kumar, learned Standing Counsel for the State respondents, and Shri Tejashvi Mishra, learned Counsel appearing for the Ghaziabad Development Authority. 2. The instant writ petition has been preferred by the petitioner for issuance of direction to the respondent no.2 and 4 to decide the representation of the petitioner and provide L.I.G. house to the petitioner on the prescribed rate and payment method, which was fixed at the time of registration of the aforesaid house by Ghaziabad Development Authority, Ghaziabad in the year 2013, according to registration book for allotment. 3. Shri Tejashvi Mishra, learned counsel appearing for the Ghaziabad Development Authority, resisted the relief on the ground that a scheme was floated by the Ghaziabad Development Authority way back in the year 2013. A total of 5000 plots/flats were to be allotted under the scheme, out of which only 4857 were allotted to applicants, and the cost of the L.I.G. was fixed at Rs.5,10,000/-. Thereafter, again in the year 2024, the remaining 143 plots/flats had again been allotted, wherein the petitioner was also allotted an L.I.G. with a revised rate of Rs.10,41,219/- alongwith cost inflation indexation. The petitioner has only deposited a token amount of Rs.20,000/- and on account of the initial deposit of said amount, the allotment letter has been issued in favour of the petitioner, wherein, the cost of the flat has been indicated as Rs.5,25,868/- and the total cost is mentioned as Rs.10,41,219/-. He submits that considering the said scheme in question and the social strata of the petitioner, who had applied under the scheme, the payment schedule has also been fixed, wherein the petitioner has been given a schedule of 15 years/60 quarterly installments with 7.5% interest per annum as per the annexure attached. He submits that once the payment of the amount has been diversified by the GDA, considering the social strata of the allottee, no interference is required in the matter. 4. We have carefully examined the record and allotment letter dated 15.09.2024, and we find that all the adequate measures have been taken by the Ghaziabad Development Authority to facilitate the petitioner in the year 2024 i.e. after 11 years of first allotment, wherein a schedule has been fixed for 15 years/60 quarterly installments for payment of entire amount. 5. Taking into account the entire facts and circumstances, we are of the view that no interference is required in the matter. The writ petition is dismissed. Order Date :- 14.7.2025 A.
