2. The petitioner apprehends his arrest in connection with Kateya P.S. Case No. 176 of 2018 registered under Sections 419 and 420 of the Indian Penal Code.

As per prosecution case, it is alleged that petitioner who was working as Panchayat Rojgar Sewak in Village- Belhikhas, Block-Kateya from 2007 to August 2012, embezzled government fund of Rs.15,17,126/- by preparing fake bills in the name of renovation under MANREGA scheme. In other words, it is alleged that petitioner paid the MANREGA labour charges to all MANREGA labourers without following legal procedure.
4. Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.71289 of 2024(3) dt.09-01-2025 2/2 submits that it is not in dispute that the work in question was not completed as it is apparent from the paragraph no. 5 of the counter affidavit filed by the State that the work has already been completed but only payment to labourers was made without following existing rules and regulations. It is submitted that petitioner has got clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail.

Having considered the fact that the work has already been completed, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 176 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
