(2) Petitioner has filed this writ petition seeking the following reliefs: “(i) Issue a writ, order or direction in the nature of Certiorari calling for the records and quashing Clause 2(J) of the advertisement dated 02.07.2020 issued by the Uttarakhand Public Service Commission (Annexure No. 7 to the Writ Petition), to the extent it requires that the OBC caste Certificate should not be more than one year old from the last date of submission of online application Form i.e. 25th August 2017, in as much as the said condition is in violation of the provisions of the Government Order dated 26th February 2016. (ii) Issue a writ, order or direction in the nature of Mandamus commanding and directing the respondent Uttarakhand Public Service Commission to treat the OBC Caste Certificate issued in favour of the Petitioner by the Tehsildar, Kashipur District Udham Singh Nagar as valid in terms of the Government Order dated 26th February 2016, for selection on the post of Assistant Professor (Education), pursuant to the advertisement dated 04th August 2017.” (3) Mr. Ashish Joshi, learned Counsel appearing for Uttarakhand Public Service Commission, has drawn attention 2025:UHC:5626-DB to averment made in para 9 of the counter affidavit, filed by Secretary, Uttarakhand Public Service Commission, wherein it is stated that petitioner participated in interview, held on 14.7.2021, however he was not selected, based on his performance in interview. It is further stated that the selection process has concluded and, therefore, writ petition has become infructuous. (4) Since the Commission permitted the petitioner to participate in the selection process and after being declared unsuccessful in the selection, based on his performance in the interview, the relief as sought in the writ petition do not survive.
