This is the second bail application filed by the applicant. The first bail application of the applicant has been dismissed as withdrawn after arguing for some time vide order dated 25.06.2024 passed in MCRC No.2440 of 2024. In the order dated 25.06.2024, the learned trial Court was directed to make its earnest endeavor to decide the case as early as possible. Learned counsel for the applicant would submit that till date 8 witnesses have been examined including the victim as well as her parents but the trial has not been concluded till date. The applicant is in jail since 29.02.2024 and the victim appears to be major as per the evidence come on record. Therefore, he filed the second bail application. 3. On the other hand, learned counsel for the State opposes. 4. Considering the submissions made by learned counsel for the applicant and further considering that the trial is in progress and 8 witnesses have already been examined till date, no liberty was granted to the applicant while dismissing his first bail application, and no change in circumstances pointed out by the learned counsel for the applicant. 5. Therefore, I am not inclined to admit the second bail application filed by the applicant. 6. Accordingly, the second bail application is dismissed at motion stage itself.
