Neutral Citation No. - 2025:AHC:111908 Court No. - 5 Case :- WRIT - A No. - 9455 of 2025 Petitioner :- Ram Sajeevan Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Kamlesh Kumar Tiwari Counsel for Respondent :- C.S.C.,Sanjay Kumar Om Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Ms. Priya Tiwari on behalf of Sri Kamlesh Kumar Tiwari,
learned counsel for the petitioner and Ms. Anita Kushwaha for Sri Sanjay Kumar Om, learned counsel for the respondent nos.2 and 3.
2. Petitioner was in a deep slumber and woke up after 10 years after his retirement (i.e. 30.6.2014) and has approached this Court in 2025 that his retiral dues such as G.P.F. as well as Group Insurance are still not released.
3. Learned counsel for the petitioner has not been able to explain any reason for such huge delay.
4. Learned counsel for the respondents is handicapped since she has not received any instructions and for that not only counsel for the Jal Nigam is put on caution, but concerned respondent is also put on caution that instructions should be provided as soon as notice is served so that the matter be heard on basis of instructions.
5. This writ petition can be dismissed only on ground for not providing sufficient reason for such a huge delay, but still considering that both counsel are young lawyers and have just joined the bar, therefore, ignoring the defects in the pleadings, this
writ petition is disposed of with liberty to petitioner to file a detail representation ventilating his grievance and in such event if a representation is filed within a period of three weeks from today before concerned respondent, he will look into the matter and decide it within a short period thereafter in accordance with law.
