P.P. --- Order No. 03 Dated 07th April, 2025 Heard the learned counsel for the respective sides. The petitioner apprehends his arrest in connection with R.C. 05(A)/2012-AHD-R. It has been alleged that the accused persons who were holding the responsible position at JPSC (Jharkhand Public Service Commission), some evaluators of the answer booklets and some candidates had committed blatant irregularities in the recruitment of Deputy Collectors in the First Combined Civil Services Examination conducted by the JPSC. It has been alleged that the favour was extended to the desired applicants by the co-accused officers and evaluators by declaring more candidates successful and they who did not follow the norms laid down by the JPSC. It has further been alleged that some of the candidates had been favoured during interview. It has been submitted by the learned counsel for the petitioner that the petitioner was not charge sheeted, but subsequently differing with the contents of the charge sheet cognizance has been taken by the learned trial court which has necessitated the petitioner preferring this application for grant of anticipatory bail. Mr. Mishra, learned counsel for the petitioner has drawn the attention of the court to the charge sheet specifically at serial No. 59 from which it appears that so far as the marks attained by the petitioner are concerned, no irregularities were detected. Mr. Deepak Kumar Bharti, learned Spl. P.P. appearing for the CBI has opposed the prayer for anticipatory bail of the petitioner and while referring to the charge sheet has submitted that there are several instances which would indicate that though the present petitioner was not charge sheeted but he along with other persons similarly situated had played an active role in league with Neutral Citation No. ( 2025:JHHC:10615 ) the evaluators as well as the other officials in committing illegalities in the recruitment process of the First Combined Civil Services Examination conducted by the JPSC. It appears from Sl. No. 59 that indeed no irregularities were detected in the marks secured by the petitioner. In fact the petitioner was not charge sheeted and charge sheet was submitted against several of the accused persons, but subsequently cognizance was taken vide order dated 16.01.2025. On consideration of the aforesaid facts, I am inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned AJC-XVIII-cum-Special Judge, CBI, Ranchi, CBI, Dhanbad in connection with R.C. 05(A)/2012-AHD-R, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
