Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 06/02/2025 1. By way of this petition, the petitioner has prayed for following Digitally signed by RAGHVENDRA JAT 2 reliefs:- “10.1. That, this Hon'ble Court may kindly be pleased to direct the respondent No.-2 to comply the transfer order and relive to the petitioner from present place of posting to transferred place for his joining, within one weeks.” 2. Brief facts of the case, is that, the petitioner is working as Lecturer (Physics) at Govt. Polytechnic, Korea, District- Baikunthpur. (C.G.). Vide order dated 15.01.2025, his services transferred from present place of posting i.e. Govt. Polytechnic, Korea, District-Baikunthpur. (C.G.) to Govt. Polytechnic, Dhamtari, District-Dhamtari. (C.G.). The transfer order dated 15.01.2025 issued by the respondent No. 1. The order of transfer dated 15.01.2025 is still in existence, no other transfer order against petitioner and no adverse order against the petitioner, but, the respondent No.-2 not complied order of transfer dated 15.01.2025 passed by higher authority and not relived to petitioner from present place of posting to transfer place, this action of the respondent No.-2 is bad and illegal. Similar issue came-up for hearing before this Hon'ble Court, in which after hearing the parties Hon'ble Court passed an order issued direction to controlling authority for reliving concerned employees, if order of transfer is not canceled. The petitioner moved representation/application before the authority for his 3 reliving, but till date petitioner not relived him from present place of posting. 3. Learned counsel for the petitioner submits that the petitioner is working as Lecturer (Physics) at Govt. Polytechnic, Korea, District-Baikunthpur. (C.G.) and on 15.01.2025, his services transferred from Government Polytechnic, Korea, District- Baikunthpur. (C.G.) to Government Polytechnic, Dhamtari, District-Dhamtari. (C.G.). The transfer order dated 15.01.2025 issued by the respondent No. 1. The order of transfer dated 15.01.2025 is still in existence, no other transfer order against petitioner and no adverse order against the petitioner, but, the respondent No.-2 not complied order of transfer dated 15.01.2025 passed by higher authority and not relived to petitioner from present place of posting to transfer place. 4. On the other hand learned counsel for the respondent/State opposes the same. 5. Respondents are directed to relieve the petitioner as he has been transferred on 15.01.2025 and till date the petitioner has not been relieved. 6. The respondent No. 2- Principal, Government Polytechnic, Korea, District-Korea, Chhattisgarh is directed to relieve the petitioner within a period of one week from production of this order. 4 7.
