Neutral Citation No. - 2025:AHC:119347 Court No. - 4 Case :- WRIT - A No. - 9338 of 2025 Petitioner :- Naim Ali Respondent :- State Of U.P.And 4 Others Counsel for Petitioner :- Anil Kumar Shukla,Sarita Jhingan Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Heard Sri Anil Kumar Shukla, learned counsel for the petitioner, Sri Ashok Mehta, learned Senior Advocate/learned Additional Advocate General assisted by Sri P.K. Srivastava, learned Additional Chief Standing Counsel for the State and Sri Pradeep Kumar Shahi, learned Standing counsel.
2. By means of this petition filed under Article 226 of the Constitution of India, the petitioner has questioned the order dated 26.05.2025 passed by the competent authority in the matter releasing a tentative seniority list with a further direction that copy of the seniority list be given to every person mentioned in the seniority list inviting objections, if any so as to finally decide the matter of seniority inter se employees.
3. Learned counsel appearing for the petitioner has argued that the seniority list should have been prepared circlewise but instead of doing this the authority has prepared the seniority list State wise and hence there is a serious irregularity committed by the authority in preparing even a tentative seniority list and for which this Court may entertain this petition.
4. On the contrary, learned Senior Advocate, Mr. Mehta has argued before this Court that since only objections have been invited at this stage and tentative seniority list is only tentative in nature yet to attain finality and that too only after the disposal
of objection of each member of the seniority list, if filed/submitted, and hence petitioner should approach the authority by filing his objection raising the plea which he is raising today before this Court. He further assures that and in the event petitioner raises a plea that plea will be considered by the authority before finalizing the seniority list.
5. In the given facts and circumstances and submission so advanced by Mr. Mehta, I decline to grant indulgence in the matter at this stage. However, it is provided that in the event petitioner files his objection to the tentative seniority list raising all the pleas available to him including plea to the effect that the seniority list should be prepared circle wise and not State-wise, within a period of four weeks from today, the same shall be accorded due
consideration by the competent respondent authority in the matter while finalising the seniority list.
6. Needless to add that while finalising the seniority list the authority shall be passing reasoned order while dealing with the objections of the members who are mentioned in the seniority list.
7. With the aforesaid observations and directions, this petition stands disposed of.
