The complainant apparently parked his car in front of the house of the accused, which has resulted in skirmishes between both and it has resulted in the present case. 2. Inspite of service of notice, the complainant has remained absent. 4. The learned High Court Government Pleader, upon instructions, submits that though the petitioners are charged with the offences under Sections 324, 504, 506 read with Section 34 of the Indian Penal Code, 1860 (for - 5 - HC-KAR NC: 2025:KHC:49935 CRL.P No. 1638 of 2023 short, 'the IPC'). Except for the statements made by the complainant, there is no record to show that the alleged injuries sustained by the complainant has been treated. He further submits that the incident led to a complaint and a counter-complaint and a complaint also was made against the present complainant and the same has ended in acquittal. 5. The allegations made in the police report against the accused in C.C.No.1776/2022 reveal that there was a fight between the complainant and accused No.1 over parking of a car by the complainant and the present petitioners (accused Nos.2 and 3) were not involved in the said fight. Further, the only allegation made against the present accused is that, subsequent to that fight, they went to the house of the complainant and verbally threatened her. There is no reliable evidence collected by the prosecution during the investigation to prove the same. - 6 - HC-KAR NC: 2025:KHC:49935 CRL.P No. 1638 of 2023 6. Under these circumstances, I am of the opinion that the continuation of the trial will only result in acquittal of the petitioners herein (accused Nos.2 and 3). Permitting the continuation of the criminal case against the present petitioners herein would be an exercise in futility, and will have to be considered as an abuse of the process of law under the given peculiar facts and circumstances of the case. Hence, the following: ORDER i. The petition is hereby allowed. ii. The proceedings in C.C.No.1776/2022, pending on the file of the Civil Judge and JMFC, Kushalanagar, insofar as it relates to the petitioners herein (accused Nos.2 and 3) are concerned, stand quashed.
