The Court made the following Order:-
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the 4th respondent in trying to dispossess the petitioner from her land in an extent of Ac.1.17 cents in Sy.No.374 of Neelakantaraopet Revenue Village, Ramapuram Mandal, YSR Kadapa District, without following any due process of law. 3. The learned counsel for the petitioner submits that the RSR of the Sy.No.374 reveals the name of Mr. Mala Pakkirugadu and the then Tahsildar, Ramapuram Mandal issued the pass book in the name of Jala Mala Basavaiah @ Yesurathnam on 06.10.1986. The petitioner’s husband died on 09.10.1990 and after his death, the petitioner submitted Family Member Certificate on the basis of Genelogical Tree Certificate issued by the 4th respondent along with 10 (1) (a) Adangle and RSR Xerox Copy for the purpose of issuance of the pattadar pass book and title deed. The petitioner’s son also submitted a representation to the 2nd respondent on 29.11.2010 in the Grievance Cell and the 2nd respondent directed the 4th respondent to look into the matter. Later, the petitioner’s son submitted representation dated 08.10.2012 to the 3rd respondent for issuance of pattadar pass book and title deed, but the same was not issued till date. However, the 4th respondent made press statement on 11.11.2019, stating that the subject land is required

for the purpose of construction of houses for poor people at low cost. Hence, this writ petition. 4.
On the other hand, the learned Assistant Government Pleader relying upon the instructions from the 4th respondent submits that the subject land is an assigned waste dry land and there are no documents for the petitioner to substantiate her title and possession over the subject land. 5. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to proceed with the subject land strictly in accordance with law, if so required for any public purpose and if the petitioner is otherwise in possession of the same, she shall be dealt with strictly in accordance with law and any dispossession from the subject land shall not be made except by following the due process of law. 6. Accordingly, this Writ Petition is disposed of. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
