JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 26.03.2025 1. Heard learned Counsel Mr. S.Das for the petitioners, 1. Satyendra Namasudra, 2. Samiran Namasudra, 3. Nandalal Namasudra, 4. Chitta Ranjan Namasudra, 5. Raju Namasudra, 6. Nirendra Namasudra, 7. Lalchand Namasudra, 8.Amar Namasudra and 9. Monoranjan Namasudra who have filed this application under Section 482 of the BNSS, 2023 with a prayer for pre- arrest bail as they are apprehending arrest in connection with Ramkrishna Nagar PS Case No. 7/2025 under Sections 191 (2)/191(3)/190/329(3)/117 (2) /118(2) of the BNS. 2. Mr. D.P.Goswami, learned Addl.Public Prosecutor is present for the respondent State. 3. The allegation against the petitioners is that they have assaulted the informant and his family members. 4. Learned Addl.Public Prosecutor submits that there are incriminating materials against the petitioners. Injuries sustained by the victim are simple injury caused by blunt weapon. 5. I have scrutinized the Case Diary. 6. The interim bail granted to the petitioners, 1. Satyendra Namasudra, 2. Samiran Namasudra, 3. Nandalal Namasudra, 4. Chitta Ranjan Namasudra on 06.03.2025 is hereby made absolute. Page No.# 4/5 7. Other petitioners are granted pre-arrest bail. 8. In the event of arrest of the petitioner Nos. 5. Raju Namasudra, 6. Nirendra Namasudra, 7. Lalchand Namasudra, 8.Amar Namasudra and 9. Monoranjan Namasudra, they shall be released on pre-arrest bail on furnishing bail bond of Rs.30,000/-each with a suitable surety of like amount to the satisfaction of the arresting authority subject to the following conditions: i) That the petitioner 5. Raju Namasudra, 6. Nirendra Namasudra, 7. Lalchand Namasudra, 8.Amar Namasudra and 9. Monoranjan Namasudra shall appear before the I.O. within one week from today and shall co-operate with the investigation, ii) That the petitioner 5. Raju Namasudra, 6. Nirendra Namasudra, 7. Lalchand Namasudra, 8.Amar Namasudra and 9. Monoranjan Namasudra shall appear before the I.O. every fortnight till completion of the investigation, iii) That the petitioner 5. Raju Namasudra, 6. Nirendra Namasudra, 7. Lalchand Namasudra, 8.Amar Namasudra and 9. Monoranjan Namasudra shall shall refrain from committing any such offence of which they are alleged with, iv) That the petitioner 5. Raju Namasudra, 6. Nirendra Namasudra, 7. Lalchand Namasudra, 8.Amar Namasudra and 9. Monoranjan Namasudra shall not leave the jurisdiction of the Court without prior permission. Page No.# 5/5 10. On breach of any of the above conditions, Court is at liberty to immediately cancel the pre-arrest bail granted to the petitioners. 11.
