Neutral Citation No. - 2025:AHC:116463 Court No. - 33 Case :- WRIT - C No. - 21805 of 2025 Petitioner :- Sanjeev Singh Rana And Another Respondent :- Union Of India And 7 Others Counsel for Petitioner :- Pankaj Lal Counsel for Respondent :- A.S.G.I.,C.S.C.,Krishna Mohan Asthana Hon'ble Prakash Padia,J. 1. The petitioner has preferred present writ petition inter-alia with the following prayers :- "I. Issue a writ, order or direction in the nature of MANDAMUS commanding/directing the respondents to provide benefit of Agricultural debt relief scheme 2008 as well as Agricultural debt relief scheme 2016." 2. A preliminary objection has been raised by Sri K. M. Asthana, learned counsel for the respondent-bank that this is 4th writ petition filed by the petitioner before this Court. In the first writ petition filed by the petitioner being Writ C No.40438/2008 was filed for the same relief as in the present writ petition, which was disposed of by Coordinate Bench of this court on 13.08.2008. The order dated 13.08.2008 reads as follows :- "Heard learned counsel for the petitioner and Siddharth, Advocate of respondent-Bank. Petitioner claims that under the Agricultural Debt Waiver and Debt Relief Scheme 2008, he is entitled the benefit provided for therein as he fulfils terms and condition. Under the aforesaid Scheme which has been framed remedy has been provided for that any incumbent who is aggrieved on the ground that his name has not been included in either of the two lists referred to in paragraph 7.1 or on the ground that his name has been included in the wrong list or on the ground that relief granted to him has been calculated wrongly, may make representation through the Branch from which he received the loan or. directly to the Grievance Redressal Officer of the lending institution concerned and thereafter said matter is to be decided within stipulated period. Learned counsel for the petitioner submits that petitioner has already made representation before the Bank Manager, Canara Bank Nirpura Baghpat on 21.07.2008. Consequently looking into the scheme and as petitioner submits that he is entitled to get the benefit of the aforesaid scheme, as such Bank Manager, Canara Bank Nirpura Baghpat is directed to decide representation of the petitioner moved in accordance with law within three months and whatever decision is taken, same be communicated to the petitioner. With the above direction present writ petition is disposed of." 3. The second writ petition was filed by the petitioner being Writ C No.1886 of 2014 in which only prayer made by him was that petitioner is ready and willing to deposit the amount in intallments. In this view of the matter, writ petition was disposed of directing the petitioner to deposit the loan amount in 12 equal bi-monthly installments. 4. It is clear from perusal of the record that aforesaid order was not complied with by the petitioners and petitioners again approached this Court by filing a petition being Writ C No.26750 of 2020. The said writ petition was dismissed as withdrawn vide order dated 06.01.2021. For the reasons best known to the petitioners now the petitioner again approached this Court by filing present writ petition. 5. From perusal of the relief sought it is clear that exact same relief was sought by the petitioner in the year 2008 by filing Writ C No.40438 of 2008. 6. In this view of the matter, it is argued by Sri K. M. Asthana, learned counsel for the respondent bank that present writ petition is not only liable to be dismissed but exemplary cost should also be imposed. 7. At this stage, a prayer has been made by counsel for the petitioners to dismissed present writ petition as not pressed. 8. In this view of the matter, present writ petition is dismissed as not pressed. However, it case petitioner will again approach this Court for the relief sought by him in the earlier writ petitions, the Court will imposed exemplary costs upon the petitioners.
