ORAL ORDER Accused No.1 to 3 and 6 in Crime No.173/2025 registered by HAL Police Station, Bangalore for the offences punishable under Sections 109, 115(2), 117(2), 118(2), 189(2), 190, 191(2), 324(3), 329(4), 351(2), 351(3), 352 of Bharatiya Nyaya Sanhita, 2023, are before this Court under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.173/2025 was registered by HAL police station, Bangalore for the aforesaid offences against Sheshanna and others based on the first information dated 23.04.2025 received from Pavan Gopal s/o. Venugopal who is the son of injured victim. 4. During the course of investigation of the case, the petitioners herein were arrested on 24.04.2025 and in their remand application, they were arrayed as accused Nos.1 to 3 and 6. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.25330/2025 was rejected on
26.05.2025. Therefore, they is before this Court. - 4 -

4. Learned Senior counsel appearing on behalf of the petitioners having reiterated the grounds urged in the petition submits that the petitioners are not the persons with criminal antecedents. Investigation is already completed. Accordingly, prays to allow the petition. 5. Per contra, the learned Additional State Public Prosecutor, who has opposed the petition, submits that first informant had suffered grievous injuries on his face. Accordingly, prays to dismiss the bail petition. 6. Perusal of the material on record would go to show that accused Nos.1, 2 and 4 were earlier working in the office of the first informant as Admins. It appears that subsequently, the first informant had terminated the said accused from service and thereafter the said accused had started a similar Company and therefore, the first informant had approached the jurisdictional police and lodged a complaint against them. It is in this background, on 23.04.2025, accused persons had entered into the office of the first informant and had assaulted on his face and eyes with hands. It is also alleged that the accused dashed the head of the complainant against the wall of

his chamber and caused bleeding injury to him.
When his employees tried to interfere, even they were assaulted by the accused persons and as a result, the employees also suffered simple injuries in the incident in question, whereas the first informant had suffered grievous injuries. 7. Undisputedly, the petitioners do not have any criminal antecedents. They are in custody for the last nearly three months. Learned Additional State Public Prosecutor has stated that investigation is completed and charge sheet is ready. 8. Under the circumstances, the prayer made by the petitioners for grant of bail needs to be answered affirmatively. Accordingly, the following:
ORDER
The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.173/2025 registered by HAL Police Station, Bangalore for the offences punishable under Sections 109, 115(2), 117(2), 118(2), 189(2), 190, 191(2), 324(3), 329(4), 351(2),

351(3), 352 of Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) The petitioners shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties each (of which, atleast one shall be local surety) for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
