Heard Mr. Yogesh Kumar Chandra, learned counsel for the petitioners. Also heard Mr. Shailendra Sharma, learned Panel Lawyer, appearing for the State-respondent. 2. The present petition has been filed by the petitioner with the following prayer: “It is therefore respectfully prayed that this Hon’ble Court may kindly be pleased to allow the petition and quash the first information report bearing crime No.107/2024, final report No.136/2024 of Police Station Gidhpuri, District Balodabazar (C.G) and entire criminal proceedings pending in Criminal Case No.3631/2024 pending before the Court of Learned Judicial Magistrate First Class, Gidhpuri, District Balodabazar (C.G) against the petitioners for the offence punishable under Section 498- A, 323/34 of Indian Penal Code, in the interest of justice.” 3. At the time of hearing, this Court observed that the prayer made in the present petition is defective one as there is no mention of the date of final report. 4. In such a situation, learned counsel for the petitioner seeks 3 permission to withdraw the present petition with liberty to file a duly constituted petition. 5. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government SAA, Baloda Bazar, (C.G.). 6.
